TERMS & CONDITIONS:
Scope of Services – Contractor will provide the aforementioned services at the rates provided above.
Compensation – The Owner shall provide a retainer of Two Thousand Dollars ($2,000.00) to be applied towards hourly services as a minimum initial payment under this Agreement. The retainer is due at the signing of this Agreement and work will commence once the retainer is received. All future payments shall be made within ten (10) calendar days of invoicing.
Term – This agreement is effective upon execution and will continue until completion of the pre-construction services, unless terminated earlier as provided herein.
Termination – Either party may terminate this agreement with fifteen (15) calendar days’ written notice. Contractor shall be paid for all services performed up to the termination date.
Use of Information – All estimates, schedules, and recommendations prepared by DBG are for the Owner’s use in planning the project and shall not be considered final or binding until incorporated into a construction agreement.
Limitation of Liability – Contractor’s liability under this agreement is limited to the fees paid for the pre-construction services. Contractor is not responsible for design errors, omissions, or decisions made by Owner or the design team.
Governing Law – This agreement shall be governed by the laws of the state in which the project is located.
